A Binding Financial Agreement is a legally enforceable agreement made under the Family Law Act 1975 that sets out how property, finances and spousal maintenance will be managed if a relationship breaks down.
These agreements can be made:
  • Before a marriage or de facto relationship (commonly known as a prenup)
